1. Other Documents.
These terms and conditions may NOT be altered, supplemented, or amended by the use of any other document(s). Any attempt to alter, supplement or amend this document or to enter an order for product(s) which is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both Customer and Australian Light Metal Pty. Ltd.

2. Governing Law.
THIS AGREEMENT AND ANY SALES THEREUNDER SHALL BE GOVERNED BY THE LAWS OF AUSTRALIA, WITHOUT REGARD TO CONFLICTS OF LAWS RULES.

3. Pricing; Payment Terms; Orders; Quotes.
Australian Light Metal Pty. Ltd. reserves the right to change or update prices and specifications at any time without prior notice. Terms of payment are within Australian Light Metal Pty. Ltd.’s sole discretion, and unless otherwise agreed to by Australian Light Metal Pty. Ltd., payment must be received by Australian Light Metal Pty. Ltd. prior to Australian Light Metal Pty. Ltd.’s acceptance of an order unless an credit term contract has been signed by both parties. Payment for the products will be made by credit card, wire transfer, Paypal, or some other prearranged payment method. Orders are not binding upon Australian Light Metal Pty. Ltd. until accepted by Australian Light Metal Pty. Ltd.. Any quotations given by Australian Light Metal Pty. Ltd. will be valid for the period stated on the quotation. Australian Light Metal Pty Ltd. reserves the right to limit the order quantity on any product and/or to refuse to ship product to any customer for any reason, or for no reason whatsoever, with or without prior notice.

4. Changing/Cancellation Order.
No change or cancellation will be accepted once the order is confirmed as accepted through email.

5. Manufacturing Period; Shipping Period.
Ordered flyscreen will be produced and ready for shipping in 7 work days excluding public holidays. For overseas product, international express takes about 6 – 15 work days to deliver products to Formosa Screens’ factory in Chelsea Heights.

6. Shipping Charges; Taxes.
Delivery request will result in two-way discussion on quoted shipping rates based on delivery location, and result in separate invoice for delivery of goods. The Flyscreen products that are shipped from overseas (Taiwan) will include no extra shipping and handling charges on top of the displayed prices in Formosascreens.com.au. All products sold in Australia through Formosascreens.com.au will associate with 10% goods and service tax (GST). GST is included in all displayed prices. It will be shown on Australian Light Metal Pty. Ltd.’s invoice.

7. Risk of Loss; Damage.
Title to products passes from Australian Light Metal Pty. Ltd. to Customer on shipment from Australian Light Metal Pty. Ltd.’s facility. Australian Light Metal Pty. Ltd. will include freight insurance for every shipping product. If loss of products in shipping is confirmed, Australian Light Metal Pty. Ltd. will re-produce and re-send the products with no extra charge. Damage that occurs during shipping by a carrier selected by Australian Light Metal Pty. Ltd. is Australian Light Metal Pty. Ltd.’s responsibility. Any damage found on the package or inside products should be checked and kept photo evidence immediately for claim and bring attention to sales at Formosa Screens.

8. Return; Refund; Replacement policies.
No Return and No Refund for all custom made products. It is customer’s responsibility to make sure the provided measurement and the colour selected fits the site. Only when product is proved to be mistakenly made from the submitted order and the installation procedure has been followed correctly, a replaced product will be provided. Please note that photo and purchase evidence will be required in claim.

9. Warranties; Disclaimers.
A 12 months (one year) warranty for defects in material and workmanship on all products listed on the Formosascreens.com.au from the date of original purchase is provided by Australian Light Metal Pty. Ltd., which does not include:
– Damages due to faulty installations;
– Normal wear and tear, natural fade or oxidation;
– Removed and re-installed to another window/door;
– Alteration;
– Damaged by external forces;
– Lack of preventive maintenance;
– Misuse and abuse;
– Damaged by fire, storm, wind, explosive device, failure of structure or impact from mechanical source;
Warranty applies to the original residential purchaser only and proof of purchase is required. If deemed a reasonable warranty claim, Australian Light Metal Pty. Ltd. will replace or repair the product and return by carrier to the original customer. All costs will be quoted directly to original residential purchaser when required. All flyscreen products from Australian Light Metal Pty. Ltd. are custom made based on the provided measurements and selected colours. No disclaimer for wrong measurement/colour and/or mistaken input of details on order will be accepted.

10. Products.
Australian Light Metal Pty. Ltd.’s policy is one of on-going product update and revision. Australian Light Metal Pty. Ltd. may revise and discontinue products at any time without notice. Prices and promotions are subject to change without notice.

11. Headings.
The section headings used herein are for convenience of reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived therefrom.

12. Acceptance. By ordering any product from Australian Light Metal Pty. Ltd., the customer agrees to be bound by these Terms and Conditions of Sale.
